Testaments r\u00e9dig\u00e9s \u00e0 la main : erreurs et id\u00e9es re\u00e7ues<\/strong><\/h2>\n\n\n\n

Lorsqu\u2019un legs \u00e0 Stop Alzheimer est pr\u00e9vu dans un testament, cela peut figurer aussi bien dans un testament r\u00e9dig\u00e9 \u00e0 la main que dans un testament notari\u00e9. Les testaments r\u00e9dig\u00e9s \u00e0 la main posent toutefois parfois des difficult\u00e9s, voire sont m\u00eame invalides, parce que la personne qui les a r\u00e9dig\u00e9s ne connaissait pas les exigences de forme et de fond. La notaire Astrid Dobbels explique quelles sont les erreurs ou les id\u00e9es re\u00e7ues les plus fr\u00e9quentes en mati\u00e8re de testament manuscrit.<\/p>\n\n\n\n

Un testament r\u00e9dig\u00e9 \u00e0 la main peut-il \u00eatre tap\u00e9 ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Tout le monde a d\u00e9j\u00e0 entendu dire qu\u2019un testament \u00e9crit sur une serviette de bi\u00e8re \u00e9tait valable. C\u2019est vrai. \u00c0 condition toutefois que vous l\u2019ayez \u00e9crit \u00e0 la main, que vous y ayez appos\u00e9 une date et que vous l\u2019ayez sign\u00e9. Beaucoup de personnes retapent un mod\u00e8le de testament puis le signent. Elles le font parce que leur \u00e9criture n\u2019est plus tellement lisible. Mais c\u2019est pr\u00e9cis\u00e9 ment le fait de le taper qui rend le testament invalide. <\/p>\n\n\n\n

La date doit-elle comporter le jour, le mois et l\u2019ann\u00e9e ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Il faut que l\u2019on sache clairement \u00e0 quel jour le testament a \u00e9t\u00e9 r\u00e9dig\u00e9, car c\u2019est le dernier
testament qui pr\u00e9vaut. En principe, le jour, le mois et l\u2019ann\u00e9e sont donc n\u00e9cessaires. Si quelqu\u2019un \u00e9crit toutefois \u201cjour de No\u00ebl 2026\u201d, cela peut suffire, car on sait alors exactement de quel jour il s\u2019agit. <\/p>\n\n\n\n

Peut-on ajouter des \u00e9l\u00e9ments plus tard ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Je constate souvent que des personnes ajoutent des choses parce que leurs souhaits
changent avec le temps. \u00c0 la longue, cela rend le testament illisible. Cela peut aussi le rendre facilement contestable, car il n\u2019est pas clair de savoir ce qui a \u00e9t\u00e9 \u00e9crit ou ajout\u00e9 \u00e0 quelle date. Il vaut mieux tout r\u00e9\u00e9crire proprement et indiquer clairement la nouvelle date. <\/p>\n\n\n\n

Les erreurs de fond rendent-elles un testament invalide ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Les erreurs de fond ne rendent pas le testament invalide, mais elles peuvent faire en sorte qu\u2019il ne soit pas ex\u00e9cut\u00e9 comme la personne l\u2019avait voulu. Je pense par exemple \u00e0 quelqu\u2019un qui l\u00e8gue tout son patrimoine \u00e0 une \u0153uvre caritative alors qu\u2019il a aussi des enfants. Ses enfants ont droit \u00e0 une part minimale de l\u2019h\u00e9ritage, la r\u00e9serve, et ils peuvent r\u00e9clamer cette part \u00e0 l\u2019\u0153uvre caritative. Une personne qui a des enfants ferait mieux d\u2019\u00e9crire : \u201cJe l\u00e8gue la plus grande part disponible de ma succession \u00e0\u2026\u201d. Beaucoup de gens ignorent aussi qu\u2019en mati\u00e8re testamentaire, il n\u2019existe pas de repr\u00e9sentation automatique, comme dans la succession l\u00e9gale. Supposons qu\u2019une personne ait un enfant et un petit-enfant. Si cette personne d\u00e9c\u00e8de et que son enfant \u2014 qui h\u00e9riterait normalement\u2014 est d\u00e9j\u00e0 d\u00e9c\u00e9d\u00e9, c\u2019est le petit-enfant qui h\u00e9ritera \u00e0 sa place. Dans un testament, cette repr\u00e9sentation ne s\u2019applique pas automatiquement : il faut l\u2019indiquer soi-m\u00eame. C\u2019est pourquoi je conseille g\u00e9n\u00e9ralement de pr\u00e9voir un deuxi\u00e8me organisme de bienfaisance au cas o\u00f9 le premier n\u2019existerait plus. Ou, \u00e0 tout le moins, de pr\u00e9voir un plan B. Sinon, votre patrimoine reviendra \u00e0 vos h\u00e9ritiers l\u00e9gaux, ce qui n\u2019est pas forc\u00e9ment votre volont\u00e9.<\/p>\n\n\n\n

Un testament r\u00e9dig\u00e9 \u00e0 la main est-il gratuit ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : L\u00e0 aussi, il existe quelques malentendus. Si le notaire r\u00e9dige un testament (que le client recopie et signe ensuite), cela entra\u00eene des frais. De m\u00eame, les testaments olographes entra\u00eenent \u00e9galement certains frais apr\u00e8s le d\u00e9c\u00e8s dans la mesure o\u00f9 le notaire doit d\u00e9poser le testament dans un acte notari\u00e9 apr\u00e8s le d\u00e9c\u00e8s. Souvent, les l\u00e9gataires universels doivent demander la mise en possession de leur legs. Cela se fait devant le tribunal, ils ont donc besoin d\u2019un avocat. S\u2019il y a un bien immobilier dans la succession, un acte distinct doit encore \u00eatre \u00e9tabli. Tout cela engendre des co\u00fbts pour les h\u00e9ritiers ou les l\u00e9gataires et prend aussi beaucoup de temps.<\/p>\n\n\n\n

Un testament r\u00e9dig\u00e9 \u00e0 la main peut-il \u00eatre contest\u00e9 ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Dans le cas d\u2019un testament r\u00e9dig\u00e9 \u00e0 la main, il arrive que des membres de la famille non b\u00e9n\u00e9ficiaires contestent le testament et pr\u00e9tendent que la personne n\u2019\u00e9tait plus capable ou qu\u2019elle n\u2019a pas elle m\u00eame \u00e9crit le document. Si vous souhaitez l\u00e9guer \u00e0 une \u0153uvre ou \u00e0 un ami et que vous avez encore des parents \u00e9loign\u00e9s, il vaut mieux faire \u00e9tablir un testament authentique par le notaire. Le notaire garantit la capacit\u00e9. Le testament est alors plus difficile \u00e0 contester pour cause d\u2019incapacit\u00e9 ou de falsification de l\u2019\u00e9criture.<\/p>\n\n\n\n

Quel conseil final pour ceux qui veulent r\u00e9diger eux-m\u00eames leurs derni\u00e8res volont\u00e9s ?<\/strong><\/p>\n\n\n\n

Notaire Dobbels : Je conseillerais surtout de ne pas aller trop vite. R\u00e9fl\u00e9chissez bien \u00e0 ce que vous voulez. Faites \u00e9ventuellement relire votre testament par une personne comp\u00e9tente. Gardez aussi \u00e0 l\u2019esprit que vos h\u00e9ritiers ou l\u00e9gataires devront encore payer des frais lorsque votre testament manuscrit prendra effet. Et m\u00eame si vous r\u00e9digez vous-m\u00eame votre testament, il vaut mieux le confier \u00e0 un notaire, afin d\u2019\u00eatre certain qu\u2019il sera retrouv\u00e9.<\/p>","protected":false},"excerpt":{"rendered":"
